Background check vs. private investigation: what’s the difference?

An instant online report and a professional background investigation are different products. One is a database search. The other is a person verifying what the databases say, and finding what they don't.

The short version
  • Instant reports aggregate data that is often outdated, incomplete or attached to the wrong person.
  • A real background investigation verifies identity first, then checks court records at the source.
  • If you are screening an employee or tenant, the Fair Credit Reporting Act applies.

What instant reports miss

  • Records under name variations, maiden names or aliases
  • Court cases in counties that aren’t digitized or aren’t in the vendor’s data
  • Civil lawsuits, judgments and business disputes
  • Records that were sealed or expunged but remain in old data
  • Mix-ups with people who share a name

What a background investigation adds

  1. Identity verification, so every record is tied to the right person.
  2. Address history, used to decide which counties to search.
  3. Criminal and civil court searches at the source.
  4. Business affiliations, liens, judgments and bankruptcies.
  5. Licenses and claimed credentials, verified.
  6. Open-source and social media research, and where useful, discreet interviews.

When the FCRA applies

If you are using a background report to decide on employment, tenancy, credit or insurance, the federal Fair Credit Reporting Act applies, including disclosure, written authorization and adverse-action notices. Personal due diligence, such as checking a date or a business partner, generally falls outside those rules, but the rules about how information is gathered still apply.

Are online background checks accurate?

They can be a starting point, but they often contain outdated or mismatched records and miss court cases that aren’t in their data.

Can a private investigator run a background check on anyone?

Detectives can research public records on most people for lawful purposes. Employment and tenant screening must follow the FCRA.
